Back then, sources revealed that Smit was staying at an apartment owned by a couple, who went out drinking the night before the accident. The couple had reportedly went into their room while the 19-year-old model rested outside. Later, she took her clothes off before walking over to the balcony where she fell over from the 20th floor.
The couple has been revealed to be American businessman Alex Johnson, 44, and his Kazakh wife Luna, 31. They admitted in an interview with the Daily Mail that they had been been drinking heavily that night while Smit took unknown drugs.
The Johnsons met Smit last October at a nightclub in Kuala Lumpur where a mutual friend introduced them.
“She asked me to stand up and dance with her. We weren’t kissing, but we were doing sexy moves,” said Luna Johnson said. “She was beautiful, charming, confident. I was already melting.”
The trio set up a WhatsApp messaging group between them where they flirted explicitly with each-other. The couple admitted to having a threesome with the model in a five-star hotel in November.
According to The Daily Star, Luna identifies as bisexual enjoys a “progressive” marriage with her husband, and has enjoyed threesomes together in the past.
On the night of the incident, the Johnsons and Smit went home in the early hours of the morning after an night of partying. The Johnsons’ daughter got up and Luna and Smit made breakfast together.
“Ivana was hammered. I kept talking to her as I got my daughter ready for school. Ivana lay down while I took her there,” Luna said before leaving the house for about 30 minutes.
When she returned, she said she found her husband and Smit on their bed, but Johnson was asleep. Luna and Smit got intimate shortly after before going back into her room to lay down with her husband.
At approximately 7:00 a.m., Smit sent a text message to her German boyfriend Lukas Kramer that read: “I love you baby. I am at a girlfriend’s house now. I will call you later.” This was the last time Kramer would hear from Smit, raising further suspicion about her death.
Luna came out at approximately 10:00 am, where she found Smit wandering around talking to herself and giggling.
“I was so tired after all this partying. At 10.15am, I went back to the bedroom. When my head hit the pillow, I passed out,” said Luna.
When she woke up at 1:25pm, Luna found Smit’s clothes, shoes, bag, and phone in the kitchen, but thought she had left for a photoshoot.
Smit’s body was found at 3:00 p.m. sprawled naked on the sixth-floor balcony of The Capsquare Residences. The Johnsons were woken up at 5:00 p.m. by police.
The couple said they were innocent, however, police were suspicious after the victim’s father, Marcel, alleged that there was foul play involved, claiming he found finger-shaped bruises on her daughter’s neck. He believes her daughter was pushed from the upper floor. Additionally the Johnsons tested positive for drugs after urine tests, but it was not revealed which drug was found.
The Johnsons have maintained their innocence in the ordeal, saying that there were footprints on the balcony and on top of the A/C units. Since the murder claim was publicized, the Johnsons said they have been subject to multiple death threats and claim there was even an attempt to kidnap their five-year-old daughter.
“A man phoned our nanny, Maha, saying he was Luna’s father and would be picking her up from school. Luna’s father died before she was born,” Johnson said. “We never intended to make the details of our marriage public. Now we fear our own lives are in danger, and we have no choice.”
Dr. Frank van de Goot, a pathologist who carried out two autopsies on Smit’s body, found “male DNA” on her body and believes it likely occurred in the last hours of her life.
“In the Netherlands, you can be prosecuted if you commit sexual acts on someone who is unconscious or under reduced consciousness,” Sebas Diekstra, the lawyer representing the victim’s family, told Dutch newspaper De Telegraaf.
Fred Agenjo, Smit’s uncle and a spokesman for the family, also said that he believes his niece was not in control of herself or actions in the hours before her death.
On Sunday, Smit’s family lawyer also told De Telegraaf that the teen had sex in the hours prior to the discovery of her body.
“There were huge amounts of drugs found in Ivana’s body. She was no longer competent,” he said. “If anyone still had sex with an 18-year-old girl who was in that condition, that’s not good. They should stay away from someone under such circumstances.”
